OG Town — Terms of Service

1. Acceptance of These Terms

Welcome to OG Town. These Terms of Service (“Terms”) govern your access to and use of OG Town, including its website, community marketplaces, virtual garages, listings, Garage Sales, Looking For requests, messaging, sponsorship features, and related services.

By creating an account, accessing OG Town, or using its services, you agree to these Terms and our Privacy Policy and Community Guidelines.

If you do not agree, you should not use OG Town.

2. What OG Town Is

OG Town is a community platform designed to help neighbors discover items, garage sales, requests, and other local opportunities within their communities.

OG Town provides tools that allow users to publish content and communicate with one another.

OG Town is not the buyer, seller, broker, payment processor, delivery provider, or party to transactions between users.

Users are responsible for deciding whether, when, where, and how to complete a transaction or interaction with another person.

3. Eligibility and Accounts

You must be at least 18 years old to create an OG Town account or use account-based features.

By creating an account, you represent that you are 18 years of age or older.

You must provide accurate information when creating and maintaining an OG Town account.

You are responsible for activity conducted through your account and for maintaining the security of your login credentials.

OG Town may require email verification and, for certain community features, residence or community verification.

Accounts may not be transferred, sold, impersonated, or used to misrepresent another person or organization.

4. Community and Residence Verification

Certain OG Town communities may be restricted to residents or other eligible participants.

OG Town may verify community eligibility through methods such as mailed verification codes, supporting residence documents, administrative verification, or other reasonable methods.

Your exact residential address is not intended to be displayed publicly merely because you provided it for verification.

A Verified Neighbor designation means OG Town has completed the applicable community/residence verification process for that account.

It does not mean that OG Town guarantees or endorses that person's identity beyond the verification performed, honesty, reliability, safety, character, products, services, statements, or future conduct.

Users should exercise their own judgment when interacting or transacting with others.

5. Garages and Listings

Eligible users may create a virtual Garage and publish items they own or are authorized to offer.

Users are responsible for ensuring that listings are accurate and that photographs, videos, descriptions, prices and other information do not materially misrepresent the item.

OG Town does not inspect, authenticate, value, warrant, or guarantee listed items.

Availability, condition, price, payment, pickup, delivery, returns and other transaction terms are determined directly between users.

6. Garage Sales

OG Town may allow users to advertise local Garage Sales.

The person creating the Garage Sale is responsible for the event, including complying with applicable laws, community rules, HOA requirements, permits or other restrictions that may apply.

OG Town does not organize, supervise or operate user-created Garage Sales.

7. Looking For

Users may publish requests describing items they are looking for.

A Looking For request is not a purchase commitment or guarantee that another user will provide the requested item.

Responses and resulting transactions remain solely between the participating users.

8. Messaging and Communications

OG Town may provide private messaging to help users communicate.

Users may not use messaging to harass, threaten, defraud, spam or otherwise violate these Terms or the Community Guidelines.

OG Town may take reasonable steps to investigate reports, enforce its policies, protect users and maintain platform integrity, subject to its Privacy Policy and applicable law.

9. User Content

You retain ownership of content you submit to OG Town.

By publishing content, you grant OG Town a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, format and distribute that content as reasonably necessary to operate, secure, promote and improve OG Town.

This permission ends when the content is deleted except where continued retention is reasonably necessary for backups, legal obligations, fraud prevention, dispute resolution, security, enforcement records or other purposes described in our Privacy Policy.

You represent that you have the necessary rights to content you upload.

10. Prohibited Items and Content

OG Town does not permit listings, requests or offers involving prohibited or unlawful goods or activities.

This includes, among other things:

• firearms, ammunition and prohibited weapons;
• illegal drugs and controlled substances;
• prescription medications offered outside lawful channels;
• stolen or counterfeit goods;
• pornography or sexually explicit material;
• live animals offered for sale or re-homing through the marketplace;
• alcohol, tobacco, nicotine and vaping products;
• hazardous or unlawful materials;
• fraudulent, deceptive or materially misleading listings;
• goods or services whose sale or distribution would violate applicable law.

OG Town may remove content or restrict accounts when reasonably necessary to enforce these rules.

Additional restrictions appear in the Community Guidelines.

11. User Conduct

Users may not use OG Town to engage in fraud, scams, harassment, threats, impersonation, spam, unlawful discrimination, malicious activity, attempts to compromise the platform, or conduct that creates unreasonable risks for other users or OG Town.

Users may report content or conduct they believe violates OG Town policies.

12. Moderation and Account Actions

OG Town may review reports and may hide, remove or restrict content.

OG Town may warn, suspend, restrict or reinstate accounts as appropriate.

Serious or repeated violations may result in longer-term or permanent loss of access.

Moderation decisions may consider platform safety, community integrity, applicable laws, previous violations and other relevant circumstances.

OG Town is not obligated to publish or continue hosting any particular user-generated content.

13. Transactions Between Users and In-Person Meetings

Transactions initiated through OG Town are agreements directly between users.

Before exchanging money or property, users should independently evaluate the item, other party and proposed transaction.

OG Town does not guarantee:

• that an item exists or matches its description;
• that a buyer will pay;
• that a seller will deliver;
• the condition, legality or safety of an item;
• the truthfulness of another user's statements;
• the outcome or safety of an in-person meeting.

Users assume responsibility for their own transactions and interactions.

In-Person Meetings

Users are responsible for deciding whether and where to meet another user. OG Town does not supervise or control in-person meetings.

Users should use reasonable precautions when meeting others, exchanging property, or completing transactions.

Choosing to meet at a residence, public location, or another location is a decision made by the participating users.

14. Community Sponsors

OG Town may allow businesses or organizations to apply to become Community Sponsors.

Community Sponsorship is subject to approval and separate Sponsorship Terms, which form part of the agreement applicable to sponsors.

Payment does not guarantee customers, leads, sales, clicks, impressions, ranking or continuous display.

Sponsor placements may rotate when more eligible sponsors exist than available display positions.

The designation Founding Sponsor may be treated differently from ordinary paid Community Sponsorships.

15. Third-Party Services

OG Town may link to or rely upon third-party services for functions such as email, hosting, storage, maps, invoicing or other infrastructure.

OG Town is not responsible for independent third-party services or their separate terms, policies or availability.

16. Platform Availability and Changes

We may modify, add, remove or discontinue features as OG Town evolves.

We do not guarantee uninterrupted or error-free availability.

Maintenance, technical failures, security events or circumstances outside our control may temporarily affect the platform.

17. Disclaimers

OG Town is provided on an “as is” and “as available” basis to the extent permitted by law.

OG Town does not make warranties regarding the accuracy of user content, quality of listed items, conduct of users, success of transactions or results obtained through the platform.

Nothing in these Terms excludes rights or warranties that cannot legally be excluded.

18. Limitation of Liability

To the fullest extent permitted by applicable law, OG Town and its operators will not be liable for indirect, incidental, special, consequential or punitive damages arising from user-to-user transactions, user content, meetings between users, loss of property, reliance on listings or use of the platform.

Nothing in these Terms limits liability where doing so would be prohibited by applicable law.

19. Changes to These Terms

OG Town may update these Terms as the platform evolves.

When changes are material, we may provide notice through the platform, email or another reasonable method and may require users to accept an updated version before continuing to use certain services.

The applicable version and effective date will be identified with the Terms.
